Terms of Service

1. About these Terms
These Terms of Service ("Terms") govern your access to and use of Akoma POS — the point-of-sale software, websites, and related services available at akomapos.com and its subdomains (the "Service"), operated from Ghana ("Akoma POS", "we", "us", "our").
By creating an account, subscribing, or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you confirm you are authorised to bind that business, and "you" refers to that business. If you do not agree, please do not use the Service.
2. The Service
Akoma POS is a cloud-based point-of-sale and shop-management tool for retailers. It helps you record sales, accept cash and mobile money, manage products, stock, branches, staff, and customers, issue receipts, and view reports.
Akoma POS is a software provider. We are not a bank, a payment service provider, or a party to the sales you make to your own customers. You collect payment from your customers directly (for example cash or mobile money) and record it in the Service; Akoma POS does not process or hold those funds.
3. Your account
You must be at least 18 years old and provide accurate, complete information when registering. You are responsible for keeping your login credentials secure and for all activity that happens under your account, including actions by staff you invite.
4. Subscriptions, billing and taxes
The Service is offered on subscription plans. Prices are shown in Ghana Cedi (GHS) on our pricing page and are billed for the term you select. Subscription fees are charged through our payment processor, Paystack.
Unless stated otherwise, subscriptions are prepaid for the chosen term. It is your responsibility to keep a valid payment method on file. Fees are exclusive of any taxes or levies that may apply, which are your responsibility unless the law requires us to collect them.
5. Free trial
We may offer a free trial. During a trial the Service may operate in a limited or "practice" mode. At the end of the trial you must subscribe to keep using paid features; otherwise your access may become read-only or be suspended.
6. Cancellation and refunds
You may stop using the Service and cancel your subscription at any time from your account or by contacting us. Cancellation stops future renewals; it does not, by itself, refund fees already paid for the current term.
Because the Service is a digital subscription, fees are generally non-refundable except where required by law or expressly agreed by us in writing. If you believe you were charged in error, contact us and we will review it in good faith.
7. Acceptable use
You agree to use the Service only for lawful business purposes and in line with these Terms and applicable law. You must not:
- sell or facilitate goods or services that are illegal in Ghana (for example fraud, counterfeit goods, or other restricted categories);
- use the Service to send unsolicited or unlawful messages to people who have not agreed to be contacted by you;
- attempt to access another merchant’s data, breach our security, reverse-engineer, or disrupt the Service;
- upload malware, or use the Service to infringe the rights of others.
8. Customer payments
You collect payment from your customers directly — for example in cash or by mobile money — and record it in the Service. Akoma POS is record-keeping software: we do not process, hold, or settle your customers’ funds, and we are not a party to those transactions.
You remain the seller of record for your sales and are responsible for the accuracy of what you record, for your own receipts, refunds, disputes, record-keeping, and tax obligations.
9. Your data
You own the business data you put into the Service, including your products, sales, and the customer records you create. You grant us a limited licence to host and process that data solely to provide and improve the Service and as described in our Privacy Policy.
For the personal data of your own customers, you are the data controller and we act as your processor. You are responsible for collecting that data lawfully and for having a valid basis to process it.
10. Our intellectual property
The Service, including its software, design, and trademarks, belongs to Akoma POS or its licensors. We grant you a non-exclusive, non-transferable right to use the Service during your subscription. You may not copy, resell, or create derivative works from the Service except as allowed by law.
11. Availability, changes and suspension
We work to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may update, add, or remove features, and we may perform maintenance.
We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Where reasonable, we will give you notice.
12. Disclaimers and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We are not liable for indirect, incidental, or consequential losses, or for lost profits, revenue, data, or goodwill.
To the extent permitted by law, our total liability arising out of or relating to the Service in any 12-month period is limited to the subscription fees you paid us for that period. Nothing in these Terms excludes liability that cannot be excluded by law.
13. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and expenses arising from your use of the Service, your sales to your customers, your content or data, or your breach of these Terms.
14. Governing law
These Terms are governed by the laws of the Republic of Ghana, and the courts of Ghana have exclusive jurisdiction over any dispute, without limiting your non-waivable statutory rights.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.
